You should be encouraged that the U.S. Department of Education (DOE) is now on the right side by standing with the truth, the law and the American people. The “Dear Colleague” [letter](https://cferfoundation.us10.list-manage.com/track/click?u=b78c84756813bc7a3a38500a0&id=43b7410d89&e=2625de7e08), sent by DOE’s Acting Assistant Secretary for Civil Rights to every Education Department in all 50 states, reaffirms the Federal Government’s commitment to equal protection and its resolve to hold all American educational institutions accountable.  
  
The letter puts schools and universities on notice that they can no longer use race or any race proxy as “a factor in admissions, financial aid, hiring, training, and other institutional programming” without facing consequences. In addition, the DOE invites the public to monitor schools and **file civil rights complaints against those failing to comply with federal civil rights laws.**  
  
If you have a potential case of a school discriminating on the basis of race, we are happy to review the case and work with you to pursue justice and accountability in the most appropriate manner. As early as 2021, CFER, along with five partner organizations, submitted a formal discrimination and civil rights violation [complaint](https://cferfoundation.us10.list-manage.com/track/click?u=b78c84756813bc7a3a38500a0&id=ceb8190cd2&e=2625de7e08) against the San Diego Unified School District regarding unlawful critical race training of teachers and employees. Due to a hostile former administration, our complaint was dismissed but this groundbreaking complaint against CRT, first in the nation at the time, generated positive media impact and greatly built awareness on the issue. We are happy to assist you with our experience and expertise!  
  
Let’s be clear: we can’t fight culture with government ALONE. This is especially true in California, where race-obsessed politicians and _educrats_ take pride in defying the federal government and perpetuating discrimination. After all, public school districts here are mainly funded by the state and local taxpayers. Sacramento’s Democratic supermajority in the legislature remains dreadfully unchanged. **More actions from the ground up are still needed.** In local school districts, for instance, we need to follow school board meetings, curriculums and school district spending to identify actionable issues, exert pressure and organize the community accordingly.  
  
On February 13, another attempt to weaken California’s constitutional guarantee of equal protection was introduced into the State Assembly. Assemblymember Corey Jackson, author of the failed proposal to circumvent Prop. 209 via research-based/-informed exemptions, is now behind [ACA 7](https://cferfoundation.us10.list-manage.com/track/click?u=b78c84756813bc7a3a38500a0&id=53865e5b50&e=2625de7e08), a new initiative to repeal key education portions of Prop. 209. In other words, Asm. Jackson wants to **make government discrimination and preferences legal again in public education, with the exception of college admissions**. If the Legislature passes ACA 7 and California voters approve it on the ballot, the state government and all educational institutions will be allowed to engage in racial discrimination, segregation and balancing in instruction, training, school activities and more. It seems that those obsessed with race will never take no as an answer!

The “Dear Colleague” letter is great. But CA. politicians attack Prop. 209 again. Continue fighting for equality from the bottom up!

We have another victory to report to you! Last week, a federal judge [granted](https://www.courthousenews.com/judge-dismisses-claim-that-san-diegos-minority-homebuyer-program-is-unconstitutional-after-it-drops-race-requirement/) a joint [motion](https://www.courthousenews.com/wp-content/uploads/2025/02/californians-for-equal-rights-foundation-v-san-diego-order.pdf) to **dismiss** [**_Californians for Equal Rights Foundation v. City of San Diego et al_**](https://strapi-cfer.nyc3.digitaloceanspaces.com/22ee6293bfb5122175466e5c159a0078.pdf). We reached a favorable settlement after the San Diego Housing Commission (SDHC) had dropped its unconstitutional race requirement in its first-time homebuyer pilot program in November 2024 and agrees to pay reasonable financial restitution to the CFER member represented by us in the lawsuit.  
  
To recap, CFER filed a federal lawsuit against the San Diego Housing Commission, City of San Diego and Housing Authority of the City of San Diego in March 2024. Our lawsuit challenged the “**City of San Diego First-Time Homebuyer Program for Middle-Income, Black, Indigenous, People of Color (BIPOC) Households**,” a pilot program launched in 2023 to help first-time, middle-income homebuyers of color to achieve home ownership in San Diego.  
  
Thanks to our legal counsel – the Pacific Legal Foundation, we were able to secure satisfactory outcomes for this case, including **the permanent repeal of a racially discriminatory program** and **financial recompense** to settle a sanctions issue (the defendant breached the protective order by violating the CFER member’s privacy).  
  
For the last four years, CFER has confronted government discrimination head on by taking a slew offending public agencies to court. Our growing track record shows CFER’s resolute commitment to equality:

-   In July 2024, we won [_CFER et al. v. Alameda County et al._](https://pacificlegal.org/wp-content/uploads/2022/07/FILED-CFER-Complaint.pdf), successfully halting two Alameda County public contracting programs that imposed race-based preferences for minority-owned enterprises.
-   Also in July 2024, we prompted City of San Francisco to cancel a gender-based public welfare program called the Guaranteed Income for Trans People (GIFT) program, which was challenged in [_CFER et al. v. City and County of San Francisco et al_](https://media.graphassets.com/02LNdMEySkSAdFz88cqC).
-   In January 2022, we reached a favorable settlement with the State Department of Education, which agreed to remove two religious chants in the Ethnic Studies Model Curriculum, challenged in [_CFER et al. v. State of California et al_](https://strapi-cfer.nyc3.digitaloceanspaces.com/9d754972393cb2a05460b02fcc06c9b8.pdf).

CFER stands at the forefront of exposing and challenging pervasive government discrimination. We are the watchdog that monitors California policies, legislation and programs related to race, gender, merit and more. While we have achieved notable progress in challenging unconstitutional discrimination in court, we must keep going. Another big win! We forced the San Diego Housing Commission to repeal its race-based housing assistance program


Great things are happening both at the federal and local levels.

Yesterday (February 4, 2025), the San Dieguito Union High School District (SDUHSD) Board of Trustees held a special  [meeting](https://go.boarddocs.com/ca/sduhsd/Board.nsf/goto?open&id=DD5PQM65BE3F)  and  **voted unanimously (5-0) to eliminate a graduation requirement for ethnic studies**. Instead, SDUHSD students will have the option to choose to take English 9 or English 9 Honor with or without Ethnic Studies. Congratulations to the SDUHSD community for this hard-fought victory as a result of months-long efforts by local watchdog groups and independent trustees Michael Alman and Phan Anderson!

On February 3, Students Against Racial Discrimination (SARD), with the help of UCLA Law Professor and CFER Advisor Richard Sander,  [filed](https://abc7.com/post/lawsuit-accuses-university-california-racial-discrimination-admissions/15865404/)  a federal lawsuit against the University of California (UC), alleging racial discrimination in the school system’s undergraduate admissions.  **Action 1:**  You can strengthen SARD’s case against one of the Golden State’s biggest discriminators by  joining  as a member as a student, a prospective student, a concerned California resident or just to share information anonymously. Parents, taxpayers and concerned community members now also have the backing of the Federal Government in their battles for excellence, equality and transparency in local education. Since January 20, a rapid succession of executive orders has been signed in an effort to curb the omnipresent invasion of woke ideologies. The following presidential actions are particularly related to education:

· “Ending Radical and Wasteful Government DEI Programs and Preferencing”: this executive  [order](https://www.whitehouse.gov/presidential-actions/2025/01/ending-radical-and-wasteful-government-dei-programs-and-preferencing/), signed by the President on January 20, requires the Federal Government take appropriate actions to terminate DEI-related grants/contracts and eliminate DEI performance requirements for federal grantees (including public schools) that receive federal funding.

· “Ending Illegal Discrimination and Restoring Merit-Based Opportunity”: signed on January 21, this  [action](https://www.whitehouse.gov/presidential-actions/2025/01/ending-illegal-discrimination-and-restoring-merit-based-opportunity/)reaffirms our nation’s civil-rights laws, decouples DEI from all future federal grants/contracts, and encourages the private sector to combat discrimination.

· “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government”: this January 20 Executive  [Order](https://www.whitehouse.gov/presidential-actions/2025/01/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government/)  mandates that federal funds not be used to promote gender ideology, including in women/girls’ sports and other areas. This is complimented by a January 28  [order](https://www.whitehouse.gov/presidential-actions/2025/01/protecting-children-from-chemical-and-surgical-mutilation/)  titled “Protecting Children From Chemical and Surgical Mutilation” and the latest “Keeping Men Out of Women’s Sports”  [action](https://www.whitehouse.gov/presidential-actions/2025/02/keeping-men-out-of-womens-sports/)  signed on February 5.

· “Ending Radical Indoctrination in K-12 Schooling”: the January 29  [order](https://www.whitehouse.gov/presidential-actions/2025/01/ending-radical-indoctrination-in-k-12-schooling/)  acknowledges parental rights and prohibits federal funds from supporting racial and gender indoctrination in all public K-12 classrooms.

· “Expanding Educational Freedom and Opportunity for Families”: the President expressed support for state-based school choice programs in this January 29 Executive  [Order](https://www.whitehouse.gov/presidential-actions/2025/01/expanding-educational-freedom-and-opportunity-for-families/).

· “Additional Measures to Combat Anti-Semitism”: a January 29 federal  [action](https://www.whitehouse.gov/presidential-actions/2025/01/additional-measures-to-combat-anti-semitism/)  directs the Education Department to investigate incidents targeting Jewish students in all educational institutions that receive federal funding.

These pro-education, anti-indoctrination Executive Orders are not just symbolic moves taken by a new federal administration. They can become powerful tools to help you fight in your local school district, which receives federal funding. If you see something, say something.  **Action 2**: Let your school board member know that the school district will lose federal funding if they carry on the indoctrination.

In the meantime, we must stay vigilant and keep up the pressure on local education policymakers who may still have their hands tied by ideologues, union operatives and far-left activists. Unfortunately, we witnessed this unfolding in the Palo Alto Unified School District (PAUSD), where the school board  [reversed](https://edsource.org/2025/anatomy-of-a-divided-school-boards-vote-on-ethnic-studies/725672)  a decision to drop ethnic studies in the face of a union campaign to hijack the public and intimidate critics. Occupied by a progressive supermajority, the State Government and the State Legislature are also actively participating in resisting federal reforms. Too often, moderate school board members, such as  [Rowena Chiu](https://palyvoice.com/180895/news/paea-revokes-endorsement-of-chiu/)  in PAUSD and  [Marc Cooper](https://www.sfgate.com/news/bayarea/article/san-jose-school-trustee-censured-for-violating-18372944.php) in the Franklin-McKinley School District, face risks of being censured, cancelled and smeared.

Parents, community members, watchdog groups and independent school board trustees need to work together to effect change, as in the case of the San Dieguito Union High School District. There is no time to relax and boast. CFER is here to support local organizing efforts throughout California: we get down to the nitty gritty by helping analyze curriculums/programs, launch local school district watchdog operations and offer practical strategies on outreach/advocacy/research.

Your actions needed in a season of positive changes

On January 6, 2025, the California Legislature reconvened and started its 2025-26 regular legislative session. Since the beginning of the new year, CFER has been monitoring new proposals introduced in the State Assembly and Senate, in preparation for our annual legislative reports. While more proposals are still being submitted for the session, we’ve flagged 12 interesting bills.

**A comeback for reparations**

After encountering setbacks in the legislature and at the governor’s desk last year, proponents of slavery reparations are gearing up for another round. So far, they have authored:

· [AB 62](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260AB62&search_keywords=equity): to legalize assistance targeting victims in seeking the return or financial compensation of the taken property under the state’s “Racial Equity Framework.” (A similar bill SB 1050 was vetoed by Governor Newsom in 2024.

· [AB 7](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260AB7&search_keywords=slavery): to mandate California’s public and private universities to provide a preference in admissions to an applicant who is a descendant of slavery.

· [AB 57](https://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=202520260AB57): for the California Housing Finance Agency to reserve funds in affordable housing for descendants of slaves.

**Racial justice and gender equity not out of fashion**

In addition to bills advancing reparations, progressive lawmakers have also introduced:

· [SB 21](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260SB21&search_keywords=equity): to create the Equity, Climate Resilience, and Quality Jobs Fund in the State Treasury and prioritize “individuals with employment barriers" to include "Indians, Alaska Natives, and Native Hawaiians" and "Transgender and gender nonconforming individuals."

· [AB 4](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260AB4&search_keywords=equity): to grant healthcare access to "who have historically and systematically faced barriers to accessing health care include people of color and immigrants, both documented and undocumented."

· [AB 73](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260AB73&search_keywords=black):  to "develop criteria for a specialty certificate program and specialized training requirements for a Black Mental Health Navigator Certification.”

· [AB 15](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260AB15&search_keywords=black): to prohibit the Department of Corrections and Rehabilitation from detaining individuals on the basis of a hold request because “California’s punitive carceral system unjustly and disproportionately harms Black, Latinx, Indigenous, and Asian and Pacific Islander American communities."

**Doubling down on ideological virtue-signaling**

The following proposals carry on the woke dogma to a lesser extent:

· [ACR 9](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260ACR9&search_keywords=equity): to recognize month of January '25 as the National Human Trafficking Awareness Month and declare that human trafficking afflicts certain racial minorities and 2SLGBTQIA+ community.

· [ACR 2](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260ACR2&search_keywords=african+american): to declare March 21 as the United Nations International Day for the Elimination of Racial Discrimination.

· [AB 96](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260AB96&search_keywords=LGBTQ): to require a community health worker to develop cultural competence including “respect for lived experience.”

**Education freedom and gender equality**

Last but not least, the Legislature’s Republican minority introduced some good legislation, the viability of which may be hampered by the Democratic supermajority:

· [SB 64](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260SB64&search_keywords=black): to establish a state trust for a school choice flex account to authorize enrollment of certain children based on parent or guardian income.

· [AB 89](https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202520260AB89&search_keywords=equity): to prohibit a pupil whose sex was assigned male at birth from participating on a girls’ interscholastic sports team.

CFER will continue to monitor new legislative proposals daily and give you updates in the coming weeks. For those bills that blatantly attack equal opportunity and merit, we will follow their progress closely and take action with position letters as well as testimony requests. 12 new California bills on reparations, equity, race and education

No matter who you supported in the last election, I hope you are encouraged by recent developments from the federal government in supporting equality, merit and free speech. **Moving a nation ensnared in political divisiveness and identity balkanization, engineered by the far-left, towards the common-sense center**should be embraced by Americans of different political persuasions.  
  
For those of us who have witnessed ideologically fueled declines in education, culture, governance and society since 2020, **the fresh array of executive actions taken to reclaim our country’s foundational values** since January 20 are the changes we have long needed. Specifically, these include **executive orders** [ending](https://www.whitehouse.gov/presidential-actions/2025/01/ending-radical-and-wasteful-government-dei-programs-and-preferencing/) federal diversity, equity and inclusion (DEI) programs, [combatting](https://www.whitehouse.gov/presidential-actions/2025/01/ending-illegal-discrimination-and-restoring-merit-based-opportunity/) racial discrimination in both public and private sectors, [restoring](https://www.whitehouse.gov/presidential-actions/2025/01/keeping-americans-safe-in-aviation/) merit in the Federal Aviation Administration, and [pushing back](https://www.whitehouse.gov/presidential-actions/2025/01/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government/) against radical transgenderism.  
  
Once again, **support for true equality is a national and bipartisan consensus**. Revoking Executive Order [11246](https://www.dol.gov/agencies/ofccp/executive-order-11246/as-amended) (federal affirmative action with a focus on preferences rather than non-discrimination) mirrors the civil rights battles fought in California to prohibit government preferences. A growing majority of Californian voters got behind the passage of Prop. 209 in 1996 and reaffirmed the state’s ban on race-based affirmative action by rejecting Prop. 16 in 2020.  
  
The proclamation to “**forge a society that is colorblind and merit-based**” on Inauguration Day not only captures the American spirit, but also echoes the words of Dr. Martin Luther King Jr., that Americans should “**not be judged by the color of their skin but by the content of their character**.” Pernicious racial politics and impulses for tribalism have poisoned American society for so long that decisive changes from top down are necessitated.  
  
There are even positive changes at the state level. In response to a federal civil rights [complained](https://defendinged.org/complaints/ocr-complaint-los-angeles-unified-school-district/) filed by Parents Defending Education – a CFER partner, the Los Angeles Unified School District has opened its $120 million Black Student Achievement Plan to all students based on academic need. Just around the New Year,  **CFER [took](https://www.cferfoundation.org/posts/sue-sacramento-county-2025) Sacramento County to court to challenge its race-based child welfare program.**  
  
Governor Newsom’s proposed 2025-26 state [budget](https://ebudget.ca.gov/) does not contain any funding plans for AB 101 (Ethnic Studies Mandate). If the finalized budget stays the same, the mandate for the controversial subject to become a high school graduation requirement will not go into effect. Following the budget release, **the Palo Alto Unified School District** [**dropped**](https://www.paloaltoonline.com/education/2025/01/17/palo-alto-unified-school-district-drops-ethnic-studies-graduation-requirement/) **the ethnic studies requirement and paused the course**.  
  
However, ideologues and progressive bureaucrats are **beginning the resistance with religious fervor**. The Massachusetts Institute of Technology, one of the first higher education institution to reinstate standardized testing in admissions and rescind DEI mandates for faculty hiring/promotion, still [requires](https://www.thecollegefix.com/mit-still-requires-dei-essay-of-grad-students-after-abandoning-faculty-pledge/) some of its graduate school applicants to submit DEI essays. The California State University (CSU) runs a K-5 teacher training [program](https://www.calstateteach.net/) that focuses on recruiting male teachers of color. CSU, a public state university that should observe Prop. 209, is also a corporate partner to the PhD Project, a public-private [partnership](https://phdproject.org/) that provides certain business Ph.D. students with financial support on the basis of race.

Making policy adjustments at the federal level is only the beginning, which risks becoming merely symbolic without local enforcement. Let’s get to work to **make sure the American dream of colorblind equality and meritocracy doesn’t just remain a dream**.  
  
If your local school district is teaching ethnic studies courses with a focus on identity, oppression, systemic racism…, urge your school board and superintendent to reconsider the curriculum. **Without state funding, local schools are not required to mandate ethnic studies**. Please make this known to your local education officials. CFER’s “indoctrination” [database](https://www.cferfoundation.org/research/crt-in-school-districts) can help you see if your local school district is currently teaching that.  
  
Last but not least, please alert CFER to policies, curriculums and initiatives that are discriminatory and potentially unconstitutional. We will take immediate action to challenge such practices through multiple channels. Changes are coming – Let’s see it through in California!


In the new year, we are staying busy and keeping our pledge to carry on the important work of safeguarding equality.

On December 31, 2024,  **CFER filed a new** [**lawsuit**](https://prod-portal-sacramento-ca.journaltech.com/public-portal/?q=node/397/2274641) **to defend our constitutional guarantee of equal protections.**  In  _CALIFORNIANS FOR EQUAL RIGHTS FOUNDATION, et al. vs COUNTY OF. SACRAMENTO, et al._, we are  **challenging a race-preferential welfare program in Sacramento**  that is only available to low-income parents of “child age 5 or younger, who is Black, American Indian, or Alaska Native.” The program is called “Family First Economic Support Pilot (FFESP).”

Represented by the American Civil Rights Project and co-counsel, our lawsuit alleges that Sacramento’s “government-sponsored and publicly funded program…designed to select beneficiaries on a racially exclusionary basis” is unconstitutional.

**We will prevail**  in our endeavor to hold Sacramento County accountable and stop its racially discriminatory program.

Even though California is the first state to ban government preferences through the passage of Prop. 209,  **public agencies at state and local levels under the far-left leadership of Governor Newsom have never shied away from assaulting equality**. From spending public funds on race-/gender-based guaranteed income programs (San Francisco), to giving minority-owned businesses favorable considerations in public contracts (Alameda), to excluding White home buyers in government mortgage assistance (San Diego), examples abound.

Thanks to our partners who alert us to these problematic policies and to public interest law groups such as the Pacific Legal Foundation and the American Civil Rights Project, CFER has been able to launch a series of[lawsuits](https://www.cferfoundation.org/legal)  in defense of equality, many of which have resulted in  [victories](https://strapi-cfer.nyc3.digitaloceanspaces.com/48fd410ec86b06b966a57cf393566149.pdf). We are  **a faithful watchdog ready and willing to take the government to court to stop unconstitutional practices and programs**.

As in previous cases, our latest lawsuit against Sacramento is a collaboration among whistleblowers, local stakeholders and public interest law. Our goal is to  **mount more legal challenges to check the far-left apparatus’s obsession with race and identity politics**. To accomplish that, we need eyes and ears on the ground.
